These Terms are the agreement between you and JIC Global Pty Ltd (ACN 660 593 537), trading as JIC Around ("JIC Around", "we", "us", "our"). They apply whenever you use www.jicaround.com (the "Site"), subscribe to our newsletter, or contact us.
By using the Site or subscribing to our newsletter, you're agreeing to these Terms. If you don't agree, don't use the Site.
These Terms should be read together with our Privacy Policy. We've tried to keep them short, clear, and on the level. They're still a legal contract — so read them properly.
Important. Nothing in these Terms excludes, restricts or modifies any right you have under the Australian Consumer Law, the Privacy Act 1988 (Cth), or any other law that cannot be excluded by contract. If anything in these Terms is inconsistent with those rights, those rights win.
1. What JIC Around is
JIC Around is a free online guide to live music, gigs and events in the Whitsunday region — mostly in and around Airlie Beach and Cannonvale, Queensland. It includes an events calendar, venue and artist pages, sports fixtures (such as the FIFA World Cup), "where to watch" information, and courtesy-bus information for local venues.
JIC Around is independent. We are not the organiser, promoter, host, venue, ticket seller, or operator of any event, venue, artist, or service listed on the Site. We gather and display information so you can find what's on. That's it.
1.1 What JIC Around is
- A free, public guide to events, venues and artists in the region.
- A free email newsletter you can choose to subscribe to.
1.2 What JIC Around is not
- A ticket seller or booking agent.
- A guarantee that any event will go ahead, at the time, place, or in the form listed.
- A guarantee that any venue, artist, offer, or service mentioned will be available.
- The operator of any venue, event, courtesy bus, taxi, or other third-party service.
2. Acceptance of these Terms
By accessing the Site or subscribing to the newsletter, you accept these Terms and our Privacy Policy. If you are using the Site on behalf of someone else, you confirm you're authorised to accept these Terms for them.
3. Eligibility
Anyone may browse the Site. However, JIC Around lists events at licensed venues and is intended for a general adult audience aged 18 and over. You must be 18 or older to subscribe to our newsletter, and by subscribing you confirm that you are. We may close or remove any newsletter subscription where we reasonably believe the subscriber is under 18.
4. The newsletter
Our newsletter is free and opt-in. We only send it to you because you've chosen to subscribe through the Site.
- The newsletter covers local gigs and events, and may also include updates about JIC Insider, our separate membership product offering deals and discounts around Airlie Beach.
- Every newsletter contains a clear, working unsubscribe option. You can unsubscribe at any time, and we'll action your request promptly and, in any event, within five business days as required by the Spam Act 2003 (Cth).
- How we handle the personal information you give us is set out in our Privacy Policy.
5. Accuracy and availability of listings
This is the most important section — please read it.
The event, venue, artist, fixture, opening-hours, pricing and other information on the Site is supplied to us by venues, promoters, artists, and other third parties, or is drawn from publicly available sources. We do not control it, and we cannot guarantee it is accurate, complete, or up to date.
In particular:
- Event dates, start times, line-ups, prices, and venues can change or be cancelled at any time, often at short notice and without telling us.
- Sports fixtures and kick-off times (including World Cup fixtures) are shown in Australian Eastern Standard Time (AEST) and may change; broadcast and screening decisions are made by venues and broadcasters, not by us.
- "Live now" indicators, weekly recurring events, and durations shown on the Site are estimates based on the information available to us and may not reflect what's actually happening on the night.
- Venue opening hours, courtesy-bus times, and similar details are set by the venues and may change without notice.
Always confirm directly with the venue or event organiser before you rely on anything you see on the Site — for example, before travelling to an event, planning your night, or relying on a courtesy bus. To the extent permitted by law, we are not responsible for any loss, inconvenience, or wasted expense caused by reliance on listings that turn out to be inaccurate, out of date, changed, or cancelled.
6. Events, venues, artists and other third parties
Every event, venue, artist, promoter, and service listed on the Site is operated by a third party, not by us. To the extent permitted by law, we are not responsible for:
- Whether an event goes ahead, or the quality, safety, or conduct of any event, venue, or performance.
- Entry requirements, dress codes, age restrictions, cover charges, capacity limits, or refusal of entry imposed by a venue or organiser.
- Ticketing, bookings, or payments you make with a venue, promoter, or ticket seller — those dealings are entirely between you and them.
- The conduct of any venue, its staff, performers, or other patrons.
If a venue or organiser sets its own terms for an event, those terms apply to your attendance, not these Terms.
7. Courtesy bus and taxi services
Where we list courtesy-bus or taxi information for local venues, those services are operated by the venues or third parties, not by JIC Around. Times, availability, routes, and terms are set by those providers and may change without notice, and services may be unavailable (for example, on public holidays). To the extent permitted by law, JIC Around accepts no responsibility for any change to, or unavailability of, those services, or for anything that happens in connection with using them. Always confirm directly with the venue or service provider.
8. Links to third-party sites
The Site contains links to third-party websites and social-media pages — including venue websites, artist Instagram pages, ticketing pages, and courtesy-bus and taxi booking pages. We provide these links for convenience only. We don't control those sites, we're not responsible for their content, products, services, or privacy practices, and a link is not an endorsement. When you follow a link away from the Site, these Terms no longer apply.
9. Intellectual property
9.1 Our material
The JIC Around name, logo, Site design, layout, original copy, and original graphics belong to JIC Global Pty Ltd or its licensors. Don't copy, reproduce, or use them outside normal use of the Site without our written permission.
9.2 Third-party material
Event posters, venue and artist logos, promotional images, photographs, and similar material displayed on the Site belong to their respective owners (such as venues, promoters, artists, or their licensors). We display this material to inform you about, and help promote, local events. We don't claim ownership of it. If you own material that appears on the Site and you'd like it changed or removed, email us and we'll action a reasonable request promptly.
10. Content you send us
10.1 Your content, your ownership
If you tag us, or send us a photo, review, or message through the Site or social media, you keep ownership of it.
10.2 Licence you give us
You give us a non-exclusive, royalty-free, worldwide licence to use that content for running and promoting JIC Around — including reposting it on our social channels. We won't use your full name or contact details in marketing without your specific consent.
10.3 Opting out
If you don't want us to use your content publicly, email us with "UGC opt-out" in the subject line. We'll stop using it and, where reasonably possible, take it down from our channels.
10.4 Standards for your content
Don't send or post content that's unlawful, defamatory, infringing, threatening, harassing, sexually explicit, or that identifies another person without their consent. We can remove content that breaches this clause.
11. Acceptable use
When you use the Site, you must not:
- Use the Site to send spam, distribute malware, or commit fraud.
- Reverse-engineer, scrape, data-mine, or systematically extract content from the Site.
- Interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure.
- Use the Site in any way that breaches the law or infringes anyone else's rights.
- Misrepresent your affiliation with JIC Around or any venue, event, or artist.
We may restrict or block access to the Site for anyone who breaches this clause.
12. Service availability
JIC Around is a web-based app (a progressive web app, or PWA). We aim to keep it running reliably, but we can't guarantee zero downtime. Scheduled maintenance, third-party outages (for example, our hosting, database, or email providers such as Lovable, Supabase, or Resend), and events outside our reasonable control can cause downtime or errors. The Site is provided free of charge, on an "as is" and "as available" basis. If a long outage affects you, you may still have a remedy under the Australian Consumer Law (see section 13).
13. Australian Consumer Law
Where the Australian Consumer Law ("ACL") applies, services supplied to a consumer come with consumer guarantees that cannot be excluded — including that services are supplied with due care and skill. Nothing in these Terms limits or excludes those rights. If a clause in these Terms appears to do so, that clause does not apply to the extent of the inconsistency. You may also be entitled to compensation for reasonably foreseeable loss or damage caused by a failure to meet a consumer guarantee.
14. Our liability
14.1 General
To the extent permitted by law (and subject to section 13), we are not liable to you for any loss, damage, cost, or inconvenience arising from:
- Your use of, or reliance on, any information on the Site — including event details, times, fixtures, opening hours, and courtesy-bus information that turns out to be inaccurate, out of date, changed, or cancelled (see section 5).
- The conduct, acts, or omissions of any venue, event organiser, artist, promoter, courtesy-bus or taxi operator, or other third party.
- Indirect, consequential, or business losses that weren't reasonably foreseeable.
- Outages, errors, or security incidents caused by third-party providers (such as Lovable, Supabase, or Resend), except to the extent our own negligence contributed.
14.2 Cap
To the extent permitted by law, and because the Site is provided free of charge, where we are found liable to you in connection with the Site or these Terms our liability is limited to re-supplying the relevant information or, at our option, AUD $100.
14.3 ACL carve-out
This section applies only as far as the law allows. Nothing in it limits your rights under the ACL or any other law that cannot be excluded by contract.
15. Privacy
How we handle your personal information is set out in our Privacy Policy. By using the Site you agree to your information being handled as described in that Policy.
16. Changes to these Terms
We may update these Terms from time to time. The current version is always at www.jicaround.com/terms with the "Last updated" date at the top. Changes take effect when posted. Where a change materially affects your rights, we'll take reasonable steps to bring it to your attention, such as a notice on the Site or an email to subscribers.
17. Disputes and complaints
17.1 Talk to us first
If you have a complaint, email support@jicaround.com. We aim to respond to all calls and emails within 24 hours and to resolve complaints within a reasonable time.
17.2 External options
If we can't resolve your complaint, you can contact:
- Queensland Office of Fair Trading — qld.gov.au/fairtrading
- Australian Competition and Consumer Commission (ACCC) — accc.gov.au
- Office of the Australian Information Commissioner (OAIC) — oaic.gov.au (privacy matters)
17.3 Governing law
These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction to hear any disputes.
18. General
18.1 Entire agreement
These Terms and the Privacy Policy are the whole agreement between you and us about your use of the Site.
18.2 Severability
If any part of these Terms is found to be unenforceable, the rest stays in force.
18.3 No waiver
If we don't enforce a clause on a particular occasion, that doesn't mean we've waived it.
18.4 Assignment
You can't transfer your rights under these Terms to anyone else. We can transfer these Terms to a successor business (for example, on a sale or restructure), and we'll let you know if we do.
